Description of the training program

On April 2, 2021, the House of Representatives approved and on April 23, 2021, the Regulatory Administrative Acts on the Management of Occupational Safety and Health Issues, R.A.A. 158/2021was implemented. A few months earlier, in December 2020, the Occupational Safety and Health at Work Act itself was amended (Law No. 89(I)/1996-2020).

The Regulations R.A.A. 158/2021 replace the Regulations R.A.A. 173/2002 in order to improve the legislation and compliance of our State with the recommendations of the competent European Authority on occupational safety and health issues. At the same time, the same regulations replace the Decree 134/1997 on Safety Committees.

The Regulations are accompanied by four decrees, (1) for the establishment of the Safety Committee (R.A.A 237/2021), (2) the Minimum Health and Safety Training (R.A.A 238/2021), (3) determining the number of Safety Representatives (R.A.A  239/2021) and (4) the Code of Practice for Employer Consultation with Employees on Safety and Health Matters (R.A.A 240/2021).

The employer is required to designate in writing the ESYPP who will accompany the employer and undertake the implementation of the requirements of the Regulations.

The employer is required to train the company’s staff engaged in Internal Protection and Prevention Services (IPPS) to meet the statutory requirement in accordance with the provisions of Regulation 17(3) of R.A.A 158/2021. Also, the minimum training for ESYPP is set at 35 hours (R.A.A 238/2021) Annex I “MINIMUM TRAINING FOR NAMINATED PERSONNEL OF ISPP or AUTHORIZED PERSONNEL or EMPLOYEES CARRYING OUT PROTECTION AND PREVENTION ACTIVITIES or CHAIRPERSONS OF SAFETY COMMITTEES”. With the amendment of the Occupational Safety and Health Act in December 2020, inspectors of the Inspectorate Department are given the power to impose extrajudicial fines of €500 for each violation of the law and regulations.

In order for businesses to comply with this need, it is necessary to train the business’ ESSYP on the requirements of the above regulation. So that the subsequent effective implementation and compliance of the company is possible. More specifically, the training of the ESYPP will help:
